The U.S. Food and Drug Administration (FDA) has for the first time authorized the sale of fruit-flavored disposable e-cigarettes through the Premarket Tobacco Product Application (PMTA) pathway, marking a significant shift in federal vaping policy in 2026.
The decision, aligned with the Trump administration’s stated goal of balancing adult access with youth prevention, allows select fruit flavors—including mango, strawberry, and blueberry—to be legally marketed for adults aged 21 and older.
Under the Obama and Biden administrations, nearly all sweet and fruit flavors were effectively banned from the U.S. market due to youth vaping concerns. The Trump White House has criticized those strict rules as too restrictive for adult smokers seeking alternatives.
In addition to flavor authorization, the FDA issued new enforcement priorities this month, stating it will not prioritize action against vaping products that have been under PMTA review for more than 180 days. This policy is expected to bring dozens of popular disposable brands, including many dual-tank models, back to retail shelves in the coming months.
Public health groups warn the move could reaccelerate underage vaping, while industry representatives argue it will reduce illegal black market sales and provide safer options for adult smokers trying to quit traditional cigarettes.
